Now, this does not mean that you can just declare bankruptcy as a get out of debt free card. Declaring for bankruptcy in Florida has a long term effect on your life.

Obviously it is different for everyone but declaring bankruptcy, and having it successfully go through, results in:

  • Bankruptcy being added to your credit report
  • Potential loss of valuables
  • Possible loss of property
  • Poor credit score

The negative aspects of bankruptcy in Florida are usually there as a result of paying off the debts. For example, if you are filing for Chapter 7 bankruptcy , more than likely you will lose valuable items because of the liquidization of your assets in order to pay your debts. 

That said bankruptcy is not the end of the world. You can recover from it and there are aspects of it that are a major positive such as becoming debt-free. When filing for bankruptcy in Florida, there are a few courses required by law to take to try and prevent you from falling back into bankruptcy. 

Throughout the bankruptcy process, there are two courses that you will need to complete. They are:

  • A credit counseling session
  • A debtor education course

Credit Counseling Session

Your credit counseling session with me will be about looking at your financial situation and making sure that bankruptcy is really the only option you have left. It’s a deep dive into your entire financial profile such as:

  • Finances
  • Income
  • Debt
  • Credit

Whether you actually need to file for bankruptcy or not is highly dependent on these factors. Sometimes you do not actually need to file for bankruptcy but instead make some tough financial decisions, or just make a course correction with how you handle your finances. 

If through our process we discover that you don’t actually need bankruptcy then that’s awesome. We can move into steps for fixing your credit and paying off your debts in a reasonable amount of time. If we find that you are in need of bankruptcy then I can give you advice on what your expectations regarding that should be.

If you are filing for Chapter 7 bankruptcy then I can assist you throughout that process as well.

Debtor Education Course

Once your bankruptcy has been filed it will go on your credit report and you will begin the proceedings that your chapter of bankruptcy requires. This could include the liquidation of assets for Chapter 7 or monthly lump sum payments for Chapter 13. Whatever bankruptcy you applied for there is still another course you must complete.

The debtor education course looks into why you fell into debt in the first place and teach you ways to avoid ever having to file for bankruptcy again. I’ll teach you financial practices and methods to keep your financial situation stable, how to create an emergency fund, and how to improve your credit.

We do not want to see you back in bankruptcy court after filing once before. This class is to help prevent a cycle of finance that you can’t recover from. 

You must complete this course before your debts can be discharged. Even if you have had all your assets liquidized until this course is complete your debts will remain. Once you have completed this course however your debts will soon be off your name and you will be able to take your life back.
